Council brings case against byelaws offender

The case of a person charged under the Douglas General Byelaws 2013 with feeding or attracting the gathering of wild birds or animals likely to cause nuisance or annoyance to any person, has been adjourned for 12 months by Her Worship, the Deputy High Bailiff, at a court held in Douglas on Wednesday, 29th January 2014.


Copy of pigeonsDouglas Borough Council brought the case against Elizabeth Helen Callow of Selborne Drive, Douglas, following a complaint by a retailer in Duke Street who saw Mrs Callow feeding pigeons outside her shop on Friday, 8th November, 2013.  He said that such feeding attracted large numbers of pigeons, some of which had flown into his shop, and that the resultant mess in the street and on his premises was not only ‘very annoying’ but also unhygienic.


 The court heard that an advocate representing Mrs Callow suggested the matter be withdrawn if she were to undertake to the Court not to feed the birds in areas as designated in the Douglas byelaws, specifically the area from the Isle of Man Steam Railway station to the end of the Sunken Gardens, via Athol Street and Finch Road and via North Quay and Loch Promenade, together with the shop premises’ frontages to Bucks Road and Prospect Terrace.


Upon the Deputy High Bailiff hearing Mrs Callow agree to this undertaking, the matter was adjourned on the clear understanding that should further reports be received, it would be returned to Court and all matters heard together.


The case has prompted the Council’s Chair of the Environmental Services Advisory Committee Councillor Ritchie McNicholl to comment: ‘The Council has made it clear on numerous occasions that in the matter of litter-related offences the time for education is long past. The Borough Wardens are now instructed to issue fixed penalty notices and pursue to prosecution those who flout the byelaws of this Borough.’
